BACK TO THE FUTUREPeter Mathiessen´s comment of today 09.01.2023: Peter Matthiessen no longer owns Aries, so it isn’t immediately obvious why the Bad Weather Problem (and its stubborn refusal to manifest itself in the real world – see, for example, the Windvane Report), but apparently not. Did someone make a resolution last week about flogging a dead horse one more time or might there be pressure coming to bear from somewhere else? Either way, Peter Matthiessen just decided to add a comment to this blog I published more than three years ago. He says:

The most important point in the letter from Nick Franklin to me is the following:

You have made a grand job of criticising the old type Aries where the servo rudder sways up to vertical. I bet the other manufacturers hate this but it is absolutely true.

So I think that we now can conclude that I was NOT inventing this as you have claimed all these years. Then you ask me to explain the bad weather problem. Are you joking? Of course you understand it. I know you read every comma on my www where I had drawings and all.

Actually, it beats me why you are so interested in this bad weather problem. For my part it is quite normal to explain improvements from the old Aries design to the new Aries design. Not? This 2. Aries was stopped because of this problem. I know you have other ideas / theories. I just copy/paste what Nick Franklin told me.
I saw some pictures you have made explaining the bad weather problem. It has NOTHING to do with a knock-down. If you did not understand my explanation on my www, you never will.

Oh no, this is endless. I did not invent anything, I have proven that. Tell whatever you like, over and out.

Peter Matthiessen no longer owns Aries, so it isn’t immediately obvious why the Bad Weather Problem (and its stubborn refusal to manifest itself in the real world – see, for example, theWindvane Report.should still be any concern of his. Perhaps he has come under pressure from Lean Nelis, who bought the company from him eight years ago. I don’t know how much faith Nelis had in the Bad Weather Problem, but he may well be feeling a measure of disappointment by now if he was expecting it to help drive Aries sales.
I must add that it pains me to see Nick Franklin’s name being dragged into this again. It is beyond disrespectful to attribute this or that intention to the man on the basis of a few partially illegible lines in a personal letter when he is no longer here to speak for himself.

EINE GANZ PRIVATE LEHRSTUNDE

Es hat ungefähr 18 Jahre gedauert, in deren Verlauf ich es hingenommen habe, dass ein damals junger Däne, der die einst seriöseste Marke von Windsteuersystemen übernommen hatte, die Seglerschaft zu verunsichern begonnen hat. Das „Bad Weather Problem“ wurde 1997 erfunden. Ich habe es als Marketing Gespenst wenig ernst genommen und in meinen Büchern entsprechend adressiert, und darauf vertraut, dass kluge Segler die hier aufgestellten Thesen, als Unsinn erkennen und entlarven.

Ein Brief von Helen Franklin ( Tochter den Aries Erfinders Nick Franklin ) in 2015 wurde zum Startschuss, meinen Standpunkt zu überdenken, nachdem deutlich geworden war, dass hier vermutlich mit Mitteln unlauteren Wettbewerbs der Marke Aries ein Vorteil verschafft worden ist. As you and me both know (and not many else, I guess) you failed completely in your resent lawyer attack on me regarding the bad weather problem. Maybe you should be honest enough now to admit that you have failed and if this is too hard for you, at least to stop spreading your lies. Hi Peter, perhaps reading of the wind vane report might be the lesson you may need to get some hints of understanding about your findings of some 20 years ago. Alternatively take this as invitation to explain in your own words about your considerations, rather than referring to a handwritten letter of Nick Franklin ( enclosed herewith ) who passed away in 2010, a letter even his own daughter failed to understand. EPILOG
Eine kurze Bemerkung zum Thema Rechtsstreitigkeiten: der geübte Leser dieses Blogs hat erfahren, dass ich eine lange Geschichte quälender und teurer internationaler Gerichtsverfahren hinter mir habe, deren Entscheidungen meist zu meinen Gunsten gefallen sind. Als jüngerer Mann war ich noch davon überzeugt, dass jeder hier investierte Cent es Wert gewesen ist, für einen erhofften und wichtigen Sieg bei Gericht alles zu geben, selbst die letzten Nerven. Mein Gerechtigkeitsempfinden ist damals uneingeschränkt unerschütterlich gewesen.

Ob mein älterer Kopf diese Weisheit noch heute teilt, dessen bin ich mir nicht mehr allzu sicher, weil in fünfzig Jahren zu viel geschehen ist, um meinen Glauben und Rechtsempfinden zu erschüttern. Ob ich, weil älter auch weiser geworden bin, ist allerdings unwichtig geworden. Das liegt daran, dass ich über erheblich bessere Rechtsberater verfüge, zuzüglich dem einen, der zeitgleich nicht weit von mir entfernt wohnt, nur wenige Zentimeter. Es würde enorme Kraftanstrengungen bedeuten, sie vom Sinn weiterer Gerichtsverfahren zu überzeugen. Warum also sollte ich mir das antun?

  1. Hallo Peter,
    jetzt weiß ich, was gemeint ist, danke. Ich weiß allerdings nicht ob,  Aries Kunden ein „Schlecht-Wetter-Problem“ hatten, es wäre mir auch egal.

    Ich weiß hingegen, dass wir mit der Funktion unserer/ Deiner Pacific auch bei hohem, achterlichen Wellengang überhaupt keine Probleme hatten, im Gegenteil.

    Knock-downs haben wir glücklicherweise nicht erlebt, aber dann wäre es meine geringste Sorge, dass mein Pendelruder (unmöglicherweise) für einige Sekunden aus dem Wasser taucht.

    viele tausend Aries und Monitor Segler haben Jahrzehnte lang akzeptiert und hingenommen, dass nach seitlicher Überlast – z.B. bei extremen Wettersituationen, Kenterung oder Durchkenterung – das Pendelruder an der Sollbruchstelle abgebrochen ist, zumal diese zum Lieferumfang gehörten. Für die Dauer der Reparatur – Erneuerung der Sollbruchstelle – musste stets von Hand oder Autopilot gesteuert werden.

    Peter Matthiessen hat die Sollbruchstelle durch ein „hinge“ Gelenk ersetzt, um die Alltagstauglichkeit ( Lift-Up ) zu verbessern, dabei vermutlich übersehen, dass seitlicher Überlastschutz fortan nicht mehr gegeben ist, oder hat er das unterschätzt? Der Mann hat das Bad Weather Problem ( BWP ) vermutlich zum Alleinstellungsmerkmal stilisiert, bzw. erfunden, um die Aries im Wettbewerbsumfeld zur einzig sicheren WSA den Seglern zu empfehlen.

    Es ist dem unschönen Marketingverhalten des Veranstalters des Golden Globe Race zu verdanken, dass 18 Segler ohne elektrische Autopilot Redundanz ihre Reise durch die hohen Breitengrade zu machen hatten. So konnte die ganze Welt die dramatischen Konsequenzen erfahren, wenn traditionelle Pendelrudersysteme keinen konstruktiven Schutz aufweisen, der das System auch nach einer Kenterung unbeschadet weiter seinen Dienst verrichten lässt.

    Ironie der Geschichte, dass es einer Veranstaltung wie der GGR bedurfte, um Merkmal und Wichtigkeit eines lateralen Überlastungsschutzes derart augenfällig zu beweisen. Es bleibt nur zu hoffen, dass der Erfinder des BWP die Fehlerhaftigkeit seiner Gedanken zumindest 20 Jahre später nun selbst erkennen kann, auch wenn er bereits seit 4 Jahren nicht mehr der Inhaber der Marke ist.

    Wie Gerard Dijkstra in seinem Kommentar zum wind vane report so treffend bemerkte, es wird immer Menschen geben, die glauben, dass die Welt eine flache Scheibe sei.

    In Bezug auf das BWP hat sich gezeigt, dass dessen Erfinder der Marke Aries einen Bärendienst erwiesen hat, indem er der Welt zu erklären suchte, dass Physik in Dänemark keine Gültigkeit besitzt.

    Dies richtig zu stellen, ist mir ein Herzensbedürfnis.

    You don’t have to be a profiler to guess the reason why you are addressing the Bad Weather Problem again EIGHT years after the Aries sale to Lean Nelis: Your successor is unhappy because a supposed unique selling point was exposed as non-existent after the publication of the Windvane Report. Instead of using Nick Franklin posthumously as proof (an unattractive gesture!) you should have contacted his daughter Helen, who knows the truth. However, you would probably have had to explain to her first why you never honoured the contract with the Franklin family, which Helen has complained about countless times. You will know the reason why you never gave her an answer. Is the karma coming back now? Does it have the name Lean Nellis?
